Roger Paiement specializes in environmental law and litigation. He provides legal counsel and represents individuals and companies in cases dealing with contaminated land brownfields (contracts, litigation, injunctions, etc.), wetlands, certificate of authorization applications under the Environment Quality Act, land protection and rehabilitation, acquired rights, land use planning, pits and quarries, landfill sites, violation of Fisheries Act, violation of Environment Quality Act (Monetary administrative penalties and penal provisions), Protection of Agricultural Territory.

Representative Work

  • Roger handled in 2007, with Mr. Robert Daigneault, the first case involving wetlands (Domaine Islemère)
  • He argued a motion for declaratory judgment for a real estate developer to clarify the concepts of “marsh” and “swamp”
  • He represented an oil company in connection with the purchase of contaminated land
  • He was involved as counsel for an important refinery in negotiating and closing an agreement with 90 residents living nearby following a contamination
  • He defended a landfill operator against residents trying to close it
  • He represented a quarry operator as part of procedures to confirm the existence of acquired rights for the operation of a pit without a certificate of authorization provided for in section 22 of the Environment Quality Act
  • He represented a real estate developer on the south shore of Montreal for a residential development where an endangered species (ginseng) was present
  • He represented a major importer of fruits and vegetables from Montreal who bought contaminated land
  • He represented a major Montreal transportation company following the purchase of a property on which waste was buried

  • He obtained an injunction on behalf of residents and a municipality to stop an illegal use of a property located on the north shore of Montreal
  • He represented a vineyard operator on the south shore in a dispute regarding his right to exploit a “country table” («table champêtre») within an agricultural zone

  • He obtained an interlocutory injunction on behalf of a trade union in order to prevent the dismantling of a factory in eastern Montreal (against Shell)
  • He handled the environmental due diligence and represented a company in the purchase of a former oil depot on the south shore
  • He represents a major construction company contesting a Monetary administrative penalty

Roger pleaded over the years several causes in civil and environmental law before civil courts of first instance and on appeal, as well as before administrative tribunals.

He regularly gives to his peers, as well as environmental consultants, conferences on wetlands, contaminated soils, environmental consultants responsibility, administrative monetary penalties, the role of the expert to the court, etc.

Roger is a mediator accredited by the Quebec Bar. He speaks fluent French and English.
